Within 6 weeks of an EHC Needs Assessment Request being made to your local authority, the local authority must decide whether the child or young person may have Special Educational Needs. They will then decide if it is necessary to provide special educational support in the form of an EHC Plan.
If the local authority refuses to assess
If your local authority refuses to assess the child or young person’s case, they must inform the parent or guardian, or the young person themselves. The local authority must also inform the parent, guardian or the young person themselves of their right to appeal against the decision.
Appeals are made through the SEND Tribunal.
